Jury Begins Deliberation in Burney Burning Death Case

Closing arguments wrapped up Thursday morning in the re-trial of a Burney man accused of burning a gas station attendant to death.

Update: The Shasta County courthouse closed for the day Thursday and jurors were sent home without reaching a decision in the retrial of 41-year-old Juan Venegas.

Venegas is accused of walking into a Burney gas station, dowsing 54-year-old attendant David Wicks in a flammable liquid and lighting him on fire back in December of 2016.

His first trial ended back in August of last year with a hung jury.

Out of those 12 jurors, eight voted Venegas not-guilty and four voted guilty.

It took them over a week to come to that decision.

And the Shasta County District Attorney's Office is hoping for a swifter decision this time around.

If convicted, Venegas faces life in prison without the possibility of parole.

The jury will return Friday morning at 9.

There's no way of knowing how long it could take them to come to a decision.


SHASTA COUNTY, Calif. - Closing arguments wrapped up Thursday morning in the re-trial of a Burney man accused of burning a gas station attendant to death.

Action News Now reporter Mario Montalvo was at the Shasta County Courthouse, where the jury was working to determine whether 41-year-old Juan Venegas will spend the rest of his life in prison. 

He is accused of walking into a Burney gas station and setting 54-year-old David Wicks on fire back in December of 2016. 

His first trial ended in August of last year with a hung jury after a week of deliberating. 

If convicted, Venegas faces life in prison without the possibility of parole.
