THERMALITO, Calif. - A Thermalito woman is upset about a recent campaign photograph Oroville mayoral candidate Janet Goodson mailed to voters on a flier.
Mikey Bryce showed Action News Now reporter Cecile Juliette the photo that has her so upset.
Bryce said someone came up to her and asked, are you supporting Janet Goodson?
"I said no," said Bryce, who said the person told her that her face is all over Goodson's campaign fliers.
Bryce says she remembers when Oroville Vice Mayor Janet Goodson came to her front yard when she met with residents of her Thermalito neighborhood.
A photo was snapped, and it ended up in Goodson's campaign literature.
"I am not even in the city," said Bryce. "I'm in the county."
Bryce says the photo misleading. 'I do not want people to think I am supporting her because I am not," she continued.
She said she told Goodson, "I am receiving calls from my friends that are not happy with me thinking I support you. Do something," she pleaded.
She said she emailed Goodson, asking her to take the photo down.
Bryce says Goodson did not respond. She claims that not only did the photo go out to registered voters in mailers, but Goodson also posted it to her "Janet Goodson for Mayor" Facebook campaign page.
The photo carried this caption: "Speaking to constituents about the increasing number of homeless and viable solutions."
This has Bryce crying foul. "I can't even vote for her. She's not even in our district," she repeated.
Goodson removed the Facebook photo after Action News Now contacted her about this story. She was not available for an interview but gave this statement. It reads in part: "He (the photographer) did not stipulate nor indicate a restriction on its use. That same picture has been used on my Janet Goodson for Mayor page as a profile picture since August 7, 2018."
Bryce says she has no plans to take any legal action, but says she wants to spread the word that she does not support Goodson's campaign.
"Now we've gone to another layer of this that I just didn't want to be involved in, and I am, and I don't want to be," says Bryce.
Action News Now checked with a copyright attorney to see if Goodson did anything wrong by using Mikey Bryce's photo without her permission. The attorney told us that it would be hard to convince a judge that the photo was a false endorsement.
