Glenn County DA: Death penalty on the table after Thanksgiving Day murder

Two brothers that were arrested for murder charges on Thanksgiving Day were in court today for a preliminary hearing.

Two brothers that were arrested for murder charges on Thanksgiving Day were in court today for a preliminary hearing.

Ricardo Garcia 25 years old, and Fernando Garcia, 19 years old are charged with attempted murder for an ambush style attack that left one man dead and another man with 8 gunshot wounds and hospitalized.

All of the men involved including the victims were in a gang fight that led to the attack.

According to the Glenn County District Attorney they will be looking into the brothers previous criminal history when deciding whether to seek the death penalty.

The District Attorney Dwayne Stewart said, "Their history is going to play a big part on whether we pick the death penalty. As we said earlier we are talking about a couple of kids, 19 and 25 year olds who go out and take the life of one person and attempt to take a life of another, very serious crimes."
