TEHAMA COUNTY, Calif. - After one man was found dead in a Red Bluff neighborhood following a fight with his neighbor, the Tehama County District Attorney's Office says the man died of a drug overdose and the neighbor will face no charges.
The death happened on Oct. 21 where investigators say David Chavez and John Weaver got into a fight outside an apartment along Mina Avenue. Police said Chavez hit Weaver repeatedly in the head and put him in a chokehold before walking off.
Initially, the district attorney's office decided to not file charges against Chavez because of "inconclusive autopsy results".
Now, seven weeks later, the office says a full blood analysis has been completed and the medical examiner has found the cause of Weaver's death to be a drug overdose. His death has been ruled accidental and the medical examiner says it was not caused by the fight between the two men.
According to the district attorney, the fight was "mutual combat" and both men had a right of self-defense.
Based on the medical reports and the investigation, the attorney's office says it will not pursue criminal charges against Chavez for the death of Weaver.
