RED BLUFF, Calif. – The Tehama County District Attorney's Office announced Friday that a man arrested for murder in Red Bluff will not face criminal charges.

The DA's office said that David Chavez was arrested as a suspect in the death of John Weaver. Investigators said that the two men got into a fight outside an apartment along Mina Avenue. Police said Chavez hit Weaver repeatedly in the head, put him in a chokehold, and then walked off.

However, investigators said it remains unclear if that fight led to Weaver's death. Weaver’s body was found Wednesday in the same area as the officer-involved shooting.

The DA's office said it will continue to work closely with the Tehama County Sheriff's Office on this open and active investigation.
