Chico City Council Votes to Repeal Scrap Metal Ordinance

In just a few months, Chico Scrap Metal may have to start packing its bags.

CHICO, Calif. -- In just a few months, Chico Scrap Metal may have to start packing its bags.

The city council officially repealed the ordinance allowing the business to stay at its East 20th Street location.

Kim Scott, co-owner of Chico Scrap Metal, said she has no plans to move Chico Scrap Metal any time soon.

Scott said she will explore all legal options to stop her business from moving, including suing the city.

Following the direction of the city attorney, the council voted 4 to 3 to repeal its decision to allow Chico Scrap Metal to remain.

Councilors Andrew Coolidge, Karl Ory, Sean Morgan and Ann Schwab voted to repeal.

This decision was already made in a July 16th special meeting, but the decision needed to be made in a normal meeting.

"There's absolutely no reason for us to move, absolutely none. We own that property, we've been there since 83, we were grandfathered in, this is something that some people seem to forget or challenge or question. There's no question in my mind that we are there as a legal nonconforming use," said Scott.

In a closed session, the council voted 3 to 2 to appeal a Butte County judge's order to repeal the ordinance or put it on the ballot.

A second review and adoption of the repeal is planned for September 4th. It will take approximately 30 to 45 days before the ordinance can become law.
