A Yuba County Sheriff's Deputy who has been charged with assaulting a man in the restroom of Chico restaurant on St. Patrick's Day has filed a civil lawsuit against the man he allegedly beat up.
The lawsuit, filed by Nelson Magana's attorney Roberto Marquez, seeks damages against Felipe Zabala and alleges that it was Zabala who initiated the St. Patrick's Day incident.
Magana last appeared in court on July 1 for a preliminary hearing, during which the judge determined there was enough information to move forward with trial. Magana has been charged with felony counts of battery and assault likely to produce great bodily injury.
The incident happened in the restrooms below Burgers and Brew restaurant on the corner of Broadway and 2nd Street. The victim reported suffering memory loss, severe headaches, and a neck injury.
Magana has pleaded not guilty to the charges and a trial has been set for November 10.
