Trinity County man fined thousands for illegal water diversion

A Trinity County man has been ordered to pay $35,000 for illegally pumping and diverting water from Hayfork Creek.

In July, the State Water Board issued a draft cease-and-desist order threatening to fine Mark Hodgetts $10,000 a day, each day he continued pumping water out of the creek.

According to the board, Hodgetts had been pumping water from Hayfork Creek and making bulk deliveries throughout the North State since 2008.

Hodgetts and the Division of Water Rights reached a settlement agreement in early October, and according to the terms of the agreement, Hodgetts must pay $35,000 in fines and is prohibited from transporting or selling water from Hayfork Creek. Hodgetts is also required to permanently disconnect his diversion system.
