Toxicology reports released in crash that killed 2 Chico State students

The California Highway Patrol has recommended that Diego Arriaga-Rodriguez be charged with DUI vehicular manslaughter.

DA Mike Ramsey said Arriaga-Rodriguez, 18, had a blood alcohol content of .06, and also had a significant amount of marijuana in his system at the time of the crash.

The crash happened Sunday, January 27th on Bidwell Avenue west of Rose Avenue, Rodriguez was traveling westbound when he lost control of his 1998 BMW crashing into the Big Chico Creek, killing 20-year-old Chico State student Austin Silver at the scene.

19-year-old Bryant Mata, who was another passenger in the car was taken to Enloe Medical Center, where he died two days later from his injuries.

Both Silver and Mata had a blood alcohol content of .07.
