A southeast Texas father is accused of killing a drunk driver in a fit of rage after his two sons were fatally struck on a rural road near their home.
Jury selection in the murder trial of David Barajas began Monday in Angleton Texas and opening statements are expected Tuesday.
Authorities allege Barajas shot Jose Banda after a December 2012 accident about 30 miles southeast of Houston. The accident claimed the lives of 12-year old David Barajas Jr. and 11-year-old Caleb Barajas.
If convicted Barajas faces life in prison. Barajas' attorney says his client didn't kill Banda. Prosecutors face various difficulties at trial, no weapon was recovered and no witnessed identified Barajas as the shooter.
