Sutter County DA says Officer involved shooting was justified

Sutter County Assistant District Attorney Jana McClung has announced that the fatal shooting of Kevin McCoshum by Yuba City Police Officer Nicholas Morawcznski and Yuba City Police Officer Vishwas Sharma on January 24, 2014, was legally justifiable defense of others and self-defense.

McClung said that Officer Morawcznski and Officer Sharma cooperated with the investigation. “The shooting of Mr. McCoshum is a tragic situation for all concerned and my condolences go out to his family. The officers were responding to a domestic violence call with an open 911 line,” said Assistant District Attorney Jana McClung. “The nature of these calls makes for a very dangerous situation for the responding officers due to the emotions and hostility involved. Mr. McCoshum was holding a rifle when contacted by officers and he refused to put the gun down despite the many commands of the officer to do so. Mr. McCoshum moved the rifle in a threatening manner causing the officers to take steps necessary to protect themselves and others.”

McCoshum was shot January 24 when officers responded to a domestic disturbance call at a mobile home park and encountered a man and woman next to a driveway. Police said the man ignored the officers' demands to put down the rifle and was shot when he moved the weapon in a threatening manner.
