Preliminary hearing for Yuba Deputy delayed

A Yuba County Sheriff's Deputy who pleaded not guilty to charges related to beating up a man in the bathroom of a Chico restaurant on St. Patrick's Day had his preliminary hearing postponed today.

Nelson Magna's defense team asked for an extension to gather more evidence.

Investigators say Magna assaulted and kicked a man, then tried to leave the scene. He was arrested for battery and threatening a witness. He faces up to seven years in prison if he is arrested.

Magna, who became a Yuba County Sheriff's Deputy in 2002 and was named "Peace Officer of The Year" in 2010, has been placed on paid administrative leave.

His preliminary hearing has been rescheduled for July 1st.
