Murder charges against a Marysville woman accused of killing and burying the body of her husband in a shallow grave have been dismissed.
Yuba County District Attorney Patrick McGrath says his office was forced to dismiss the murder charge against Monica Rodriguez, 33, because of inconclusive evidence and a reluctance to testify by key witnesses.
Rodriguez reported her husband Juan Rodriguez missing in January 2015, and according to the Yuba County Sheriff’s Department, a tip from an anonymous source led detectives to his grave in Plumas Lake on May 29.
Investigators then served a search warrant at Rodriguez’s home and found evidence that led to her arrest.
Two women, Lorena Ruiz and Maria Vega, who investigators said helped Rodriguez get rid of the body have also had accessory to murder after the fact charges dismissed.
McGrath said his office can re-file a murder charge against Rodriguez if new evidence is presented.
