Jury begins deliberating in former deputy's assault case

Arguments came to a close and a Butte County jury began deliberating Tuesday in the case of a former Yuba County Sheriff's Deputy charged with assault.

Nelson Magana, 32, is accused of beating a man unconscious in the basement bathrooms beneath Burgers and Brew and Crush restaurant in Chico on St. Patrick's Day last year. Magana was a Yuba County sheriff's deputy at the time of the incident, but he is no longer employed by the county.

The prosecution called several law enforcement witnesses to the stand Tuesday. A Chico Police Officer testified that during the night of the incident, Magana was adamant he had not been in a fight, but said Magana also changed his statement several times and then said he had fought back.

The fight reportedly started when a group of people told Magana he used steroids. A friend said the man Magana fought with made a death threat against Magana. Both men involved were reportedly drunk at the time of the alleged incident.

The jury received the case late Tuesday afternoon following closing arguments from the prosecution and defense. The judge instructed jurors to deliberate for an hour, before returning for further deliberations Friday.
