Judge to decide on taking serial rapist back into custody

SAN FRANCISCO (AP) - A California judge is mulling whether to revoke the release of a serial rapist after he twice let battery power run too low in his ankle monitor.

"Pillowcase rapist" Christopher Hubbart testified Wednesday that forgetfulness and inattention led to the mistakes.

Hubbart's monitor was out of commission for two minutes in September, though two live-in guards were with him.

Prosecutors sought to revoke Hubbart's release from a state mental hospital because of the violations.

Hubbart was released in July to a neighborhood in Antelope Valley in the desert near Los Angeles. Protesters have appeared outside his house almost daily.

The Santa Clara County judge is expected to issue a written ruling within 90 days.
