Grand Jury indictments against Butte County men released by US AttorneyĆ¢??s Office

United States Attorney Benjamin B. Wagner released the indictments of two Butte County men who are both facing multiple child pornography charges.

25-year-old Jesse Davenport (a.k.a. Draco John Flama) of Chico was handed a three-count indictment from a federal grand jury for receiving and disturbing child pornography between August 27 and September 4 of this year. The case was investigated by the FBI, the California Parole Board, and the Butte County District Attorney’s Office.

Bret Allan Nichols, age 29 of Paradise, faces a two-count indictment for using a minor to engage in sexually explicit conduct and recording it between August 20 and 23 of 2012, according to the indictment. The indictment further indicated Nichols downloaded child pornography through the internet.

Nichols was a former clerk at the Butte County Superior Court Office but resigned in light of the investigation against him, according to court officials.

If convicted of producing child porn, Nichols potentially faces 15 to 30 years in prison along with a $250,000 fine. If both Nichols and Davenport are convicted of receiving or distributing child porn, they both face a statutory penalty of five to 20 years in prison and a $250,000 fine. All sentences however are determined at the discretion of the court.

Both men are currently in custody. Davenport is scheduled to be arraigned December 20 and Nichols’ arraignment is scheduled for December 17.
