Former Yuba deputy not guilty in assault case

A Butte County jury has found a former Yuba County sheriff's deputy not guilty of assaulting a man on St. Patrick's Day in Chico last year.

The jury's decision came after a five day trial and four hours of deliberations.

Nelson Magana, 32, was found not guilty of felony battery with the serious injury of unconsciousness, assault by means likely to produce great bodily injury and dissuading a witness from reporting a crime.

Prosecutors alleged that Magana beat a man unconscious in the basement bathrooms beneath Burgers and Brew and Crush restaurant in Chico on St. Patrick's Day last year.

Magana was a Yuba County sheriff's deputy at the time of the incident, but he is no longer employed by the county.
