Butte County District Attorney Mike Ramsey announced Thursday that the actions taken by a Butte County Sheriff's Deputy during an arrest that was caught on video last month were justified.
Ramsey held a press conference Thursday at the Board of Supervisors Chambers to announce the findings of his investigation.
The investigation began after Deputy Sam Burnett tried to place suspect Terry Collins under arrest. Collins reportedly became aggressive and a fight ensued, Deputy Burnett was recorded by a bystander kicking Collins near the head when he appeared to be complying.
Burnett has been on administrative leave since the incident happened around 11 a.m. August 26 on Myers Street in Oroville.
During the press conference Ramsey said at the end of the video the witness can be heard saying the cop was getting badly beat up by the suspect. Ramsey said the deputy is trained to kick a combative suspect in the shoulder to minimize the threat, and what Deputy Burnett did was "textbook".
Collins was released from jail on Friday, and Deputy Burnett has been cleared to return to duty.
