The Red Bluff man accused of killing 14-year-old high school student Marysa Nichols had his court proceeding postponed again Wednesday morning.
In April the defense began seeking a change of venue to ensure a fair trial, the motion was scheduled to be heard Wednesday, but the defense did not file the motion in time. Bealer's attorney says there is no way he can get a fair trial in Tehama County.
The defense said they will file a new motion today. Both sides are now scheduled to meet October 9 for action of the venue change.
Marysa Nichols was last seen on February 26, 2013 as she was walking home from school. Her body was found two days later in a creek near Red Bluff High School. Investigators determined she had been strangled.
Bealer was caught on security tape in the area that Nichols was last seen and investigators deemed him a person of interest in the case, he turned himself in March 2.
